Onboarding Best Practices - Contractors

While HR professionals are becoming increasingly aware of compliance and onboarding best practices for their own employees, the rules that apply to the employer/contractor relationship are still poorly understood. Immigration and Customs Enforcement (ICE) has made it clear that they will now hold employers responsible for the worker eligibility verification practices of a company’s contractors and subcontractors. Business owners should require that contractors provide comprehensive information regarding their I9 administration process. They should also inquire as to the date of the contractor’s last I9 audit (these should be done annually) to ensure compliance with immigration law. Another area where the rules for outside contractors can be confusing is state new hire reporting. About a dozen states require that employers report contractors as new hires for child support enforcement purposes. In some locations, such as Massachusetts, this requirement only becomes effective if the contractor is paid over $600 per year. In other states the amount is much higher. This is one reason employers should use onboarding software that not only automates reporting but can modify data flow based on state law and internal business rules.
